Limits on what they may do

• Restriction on new business

  Requirements 1. The Firm will not, without the consent of the Authority, take on new customers and/or referrals either directly, or via Lead Generators or via other members of the Bridgewater Finance Group where this could involve the Firm subsequently engaging in debt counselling (or an activity that would be debt counselling if carried on in relation to a debt under a credit agreement or a consumer hire agreement), debt adjusting or credit broking 2. The Firm will advise existing customers of the Firm (who have not yet received a recommended course of action from the Firm) to contact an alternative debt advice body to seek further advice and signpost those customers to the Money Helper website. 3. The Firm will remove any information on websites registered to or linked with its business which state or indicate the provision of services relating to debt counselling (or an activity that would be debt counselling if carried on in relation to a credit agreement or a consumer hire agreement), debt adjusting or credit broking, with immediate effect. 4. The Firm will put in place appropriate policies and processes, which will require approval from the Authority, to ensure it has access to and holds complete customer files for a reasonable period of time so as to evidence the full and complete customer journey. This is to include cases involving customer referrals from Lead Generator(s) within or outside of the Bridgewater Finance Group where the Firm could or does subsequently engage in debt-counselling (or an activity that would be debt counselling if carried on in relation to a debt under a credit agreement or a consumer hire agreement), debt adjusting or credit broking. 5. The Firm must provide written confirmation to the Authority that it is in compliance with Requirements 1-3 by close of business on the third day following the effective date in Requirement 7. 6. The Requirements will take effect on the Effective Date and stay in effect until the Authority is satisfied (by reference to remedial action taken) that they can be lifted. Effective Date 7. The Requirements are to take effect immediately on their acceptance by the Authority and notification of such to the Firm via email (the “Effective Date”).
