    On 31 May 2013, the FCA imposed a financial penalty of £120,900 on Xcap Securities Plc for breach of Principle 3 (management and control) and Principle 10 (client assets) and breach of certain rules within the Client Assets Sourcebook. The breaches occurred between 29 June 2010 and 31 August 2011 (the Relevant Period). Xcap agreed to settle under the FCA's executive settlement procedures at an early stage of the FCA's investigation and therefore qualified for a Stage 2 discount (20%). Were it not for this discount, the FCA would have imposed a financial penalty of £151,136. In the Relevant Period, there were serious failings by Xcap to adequately protect client money and client assets. Xcap's breaches included failure to properly segregate client money from its own, failure to maintain accurate records and accounts of client money and safe custody assets and failure to carry out accurate client money reconciliations. This resulted in the risk that, had Xcap become insolvent, its clients could have faced difficulties and delay in recovering their money and assets
