One supervisory condition set by the FCA

  • The Firm must cease providing advice on or arranging transactions in relation to investment bonds for new clients, and must not in any way dispose of, withdraw, lend, transfer, deal with or diminish the value of its own capital or assets.
    Restrictions on regulated activities 1. The Firm must not, without prior written consent of the FCA: (1) Take on new clients for the purpose of providing advice on or arranging transactions in relation to investment bonds; and (2) Provide advice on or arrange transactions for existing clients in relation to investment bonds unless the advice has been checked and assessed by the Third Party to be suitable advice prior to the client’s agreement to the transaction. Assets restriction 2. Save as set out at paragraph 3 below, the Firm must not, without the prior written consent of the FCA, take any action which as the effect of disposing of, withdrawing, lending, transferring, dealing with, or diminishing the value of any assets it holds or receives for itself or on behalf of another (whether in the United Kingdom or elsewhere). Only the Firm can seek such written consent from the FCA (any such request to be accompanied by appropriate supporting evidence) pursuant to the terms of this Requirement. 3. The assets restriction in paragraph 2 does not apply to: (1) Transactions giving effect to instructions initiated by clients; (2) Payments of funds to the Firm’s suppliers in the ordinary course of business and in satisfaction of the Firm’s contractual and legal obligations; (3) Usual and proper salary payments made by the Firm; (4) Payments of funds in accordance with any award or direction made by the Financial Ombudsman Service; (5) Payments to professional advisors;
