The Financial Conduct Authority (the FCA) issued a Final Notice against John Joseph Financial Services Limited (JJFS ) of Elstree House Elstree Way Borehamwood Hertfordshire WD6 1SD on 30 September 2015 which imposed a financial penalty of £20,000 in respect of breaches of Principle 9 during the period between August 2005 and June 2006 and November to December 2008 arising from its sales of Keydata life settlement products. JJFS failed, in breach of Principle 9 and certain rules of COB and COBS, to take reasonable care to ensure the suitability of its advice for any customer who was entitled to rely upon its judgment in relation to sales of the Keydata Products, in that it failed to properly disclose to customers the risks arising from lack of diversification of investments in their investment portfolio, failed to assess adequately the needs and circumstances of customers, and their appetite for risk, and failed to disclose adequately all material risks of the Keydata Products. JJFS also failed, in breach of certain rules of SYSC, to take reasonable care to establish and maintain effective systems and controls for compliance with applicable standards and requirements of the regulatory system. JJFS did not take reasonable care to create and retain records of matters and dealings which were the subject of requirements and standards under the regulatory system and its method of monitoring and reviewing its Keydata Product sales process was inadequate.
