Fined £1.23m on 13 April 2010
On 12 April 2010 the Financial Services Authority ('the FSA') imposed a financial penalty of £1.225 million on Kensington Mortgage Company Limited ('Kensington') for breaches of Principle 3 (Management and Control) and Principle 6 (Customers' interests). Kensington failed to establish and maintain a clear and appropriate apportionment of significant influence responsibilities among its directors and senior managers and failed to establish and maintain sufficient oversight of its processes and procedures. In addition, Kensington failed to pay due regard to the interests of certain of its customers and treat them fairly in handling its mortgage arrears and repossessions activities and applied charges to customers' accounts that were unfair and/or excessive. The FSA's action took effect on 12 April 2010, and a copy of the Final Notice, which sets out the reason for the action, is displayed on the FSA's web site and can be accessed.
