Firm’s London branch prohibition and attestation regarding dealing with unauthorised and unonboarded introducers and distributors
1. The Firm’s London Branch must not: a) enter into agreements with; b) deal with; or c) pay commission or other payments to: any business introducer, distributor of financial products or any third party performing a similar function, unless each such party: (i) has been approved for the purpose pursuant to the Firm’s onboarding control process; and (ii) is authorised by the Authority or an equivalent financial regulator in the jurisdiction where it is domiciled. 2. The Firm’s London branch must not otherwise knowingly facilitate or arrange any of the above, or facilitate or arrange in circumstances where it would be reasonable to believe that this would be done through the other offices of the Firm or otherwise. 3. By no later than 1 April each year, the Firm’s London Branch must: a) take reasonable steps to satisfy itself that the terms of requirement 1 and 2 have been complied with in the preceding year; and b) provide the Authority with confirmation, through an attestation signed by the individual holding the Head of third country branch function (SMF19) in respect of the Firm’s London Branch, either that, on the basis of the steps identified in requirement 3a), he/she is satisfied that the Firm’s London Branch has complied with requirements 1 and 2 in the preceding year and/or identifying to the Authority any breaches of requirements 1 and 2 committed by the Firm’s London Branch in the preceding year.
