    On 29 April 2019 the Financial Conduct Authority (the ‘FCA’) issued to Linear Investments Limited (“Linear”) a Final Notice, which imposed a penalty: https://www.fca.org.uk/publication/final-notices/linear-investments-ltd-final-notice-2019.pdf   The FCA’s Final Notice was issued pursuant to the Upper Tribunal’s decision in relation to this matter released on 9 April 2019: Linear Investments Ltd v The Financial Conduct Authority: [2019] UKUT 0115 (TCC)
  • Decision notice issued on 27 September 2018, under appeal
    On 27 September 2018 the Financial Conduct Authority (FCA) published a Decision Notice in respect of Linear Investments Limited (Linear).  The Decision Notice was in respect of Principle 3 of the FCA’s Principles for Businesses, specifically that Linear failed to take reasonable care to organise and control its affairs responsibly and effectively to ensure potential instances of market abuse could be detected and reported. The failure occurred from 14 January 2013 to 9 August 2015.   Linear has agreed the facts set out in the Notice, as well as liability for the breaches identified.  LINEAR DISPUTES THE PENALTY IMPOSED AND HAS REFERRED THE ISSUE OF PENALTY TO THE UPPER TRIBUNAL.  THE UPPER TRIBUNAL WILL DETERMINE WHAT (IF ANY) THE APPROPRIATE ACTION IS FOR THE FCA TO TAKE, AND REMIT THE MATTER TO THE FCA WITH SUCH DIRECTIONS AS THE UPPER TRIBUNAL CONSIDERS APPROPRIATE.
