Operator/depositary/trustee of a temporary recognised scheme

This is a firm that, as a result of being the operator, trustee, or depositary of a UCITS scheme set up in another European Economic Area (EEA) country that was marketed under a passport in the UK before exit day, was allowed to operate in that capacity in the UK, in relation to those UCITS schemes marketed under a passport. The UK Government established a temporary marketing permissions regime which provides a limited period of time during which firms can continue to market, in the same manner as they did before the end of the transition period, some or all of the funds they previously marketed under a passport in the UK. Accordingly, the operators, trustees, and depositaries of such funds will continue to be authorised persons, with permission to operate in that capacity in the UK in respect of such funds, whilst the funds are in the temporary marketing permissions regime. Consumers doing business with firms in contractual run-off may wish to ask for further information from the firm about the basis on which the firm is doing business with UK customers and, in particular, how complaints and compensation arrangements apply to UK customers. A firm based in an EEA State, may not be covered by a compensation scheme or not to the same extent as a UK authorised firm. The right to refer a matter to a dispute resolution scheme may not exist or may be more difficult for a UK customer to use.
