  • International firms – fund manager prudential requirement
    1. The Firm has been authorised on the basis that the whole firm is subject to prudential regulation in its home state under the home state’s implementation of the AIFMD or UCITS Directive and is not authorised by the home state authority to undertake and does not otherwise undertake where its authorisation does not prevent, individual portfolio management or any other investment service or activity, subject to any safeguards set out below. 2. The Firm must not take any action that could have a material adverse impact on the basis of the Firm’s authorisation in 1. without prior authorisation from the FCA. 3. An action in 2. includes: a) any change to the Firm’s regulatory status in its home jurisdiction which could affect the prudential requirements applicable to it there; b) any change to the Firm’s activities, whether in the UK or overseas, which could affect the prudential requirements applicable to it in its home jurisdiction; and c) any change to the Firm’s activities, whether in the UK or overseas, which would have resulted in the application of additional prudential requirements to a UK firm and which therefore ought to be considered as part of the FCA’s assessment in 1. 4.
