Limits on what they may do

• Limitation of claims management activities

  The Firm is prohibited from providing customers with any services (the Relevant Services) the provision of which amount to the carrying on of the regulated activity specified in Article 891 of the FSMA (Regulated Activities) Order 2001 (RAO), to the extent that those services relate to claims or potential claims made or to be made against: (a) Fantrac Global Limited (Fantrac); or (b) Any other entity that is, or has ever been, owned, controlled, directed or managed by a person who owns, controls, directs or manages the Firm or one of their relatives. The Firm must, within 14 business days from the Effective Date, write to all existing customers on behalf of whom it has, before the Effective Date, provided or agreed to provide Relevant Services, giving the customer the following options for progressing the claim: A copy of the proposed correspondence will be forwarded to the FCA for its approval prior to circulation to the existing clients. (a) The first option (Option 1) is that the customer may pursue the claim themselves, and the Firm's communication must explain that the customer may do so directly and free of charge. If the customer chooses Option 1, the Firm must, within 30 business days the Effective Date return to the customer all personal data relating to that customer (b) The second option (Option 2) is that the existing customer, with full knowledge of the circumstances, may continue to use MRCS to act on their behalf
