Publicly censured on 23 March 2009
On 23 March 2009, the FSA issued a public censure against Mortgages Remortgages for failing to comply with Principle 9 of the FSA's Principles for Businesses and FSA Rules. These breaches relate to Mortgages Remortgages' deficiencies in connection with the operation of its mortgage sales process. Mortgages Remortgages is a small mortgage broker, and has been regulated by the FSA since 31 October 2004. Its authorised business also includes advising on and arranging insurance contracts. The FSA's Small Firm's Division (SFD) visited Mortgages Remortgages as part of its thematic work on the sale of self certification mortgage products in August 2007. The visit identified a number of concerns relating to Mortgages Remortgages' practices; and its systems and controls. This suggested that, amongst other things, it was failing to ensure the suitability of its advice and the matter was referred to the FSA's Enforcement Division (Enforcement) in January 2008. The investigation established that Mortgages Remortgages failed to demonstrate that it had taken reasonable steps to ensure the suitability of its advice in accordance with Principle 9 in that it failed to gather and record sufficient personal and financial information about its customers to demonstrate the suitability of, and the reasons for, its recommendations. In particular, Mortgages Remortgages failed to make appropriate enquiries about customers' income, expenditure, credit history and debt position, for it to properly assess the affordability of its recommendations. By Executive Stage settlement, Mortgages Remortgages is publicly censured. The FSA considered that the failings would have warranted a financial penalty of £20,000 were it not for the financial position of the firm. The Firm has also agreed to carry out a customer contact and remediation exercise.
