  • Capital Requirements on Dealing Client positions
    1. With effect from 25 October 2012, OSL must treat all dealing client accounts as if they were proprietary accounts for the purposes of Block 2 (Prudential Standards) of the Handbook. As such any positions and balances held on dealing client accounts must be treated as proprietary positions when OSL carries out any calculations of the amount of regulatory capital that it is required to hold. 2. OSL must immediately carry out a revised calculation of its regulatory capital requirements as a result of this variation of its permission, and must provide the FSA with a credible plan to resolve any resulting breach of its regulatory capital requirement by 1 November 2012. 3. This requirement on OSL's permission will remain in place until the FSA is satisfied that OSL does not bear proprietary risk arising from positions held on dealing client accounts. 4. OSL must continue to treat dealing clients' money in accordance with the applicable provisions in CASS and shall segregate such money in a separate account in accordance with CASS 7.4.21. R.
