The Firm must comply with the obligations in MIFIDPRU and SUP 16.12 (Integrated Regulatory Reporting) as if the whole firm were a MIFIDPRU investment firm, subject to the modifications below. Modifications to definitions are modifications to definitions as they are used, directly or indirectly, in MIFIDPRU or SUP 16.12. 1. MIFIDPRU 2.1.1R(4) is modified as follows: a parent undertaking in the UK or the EEA that is a relevant financial undertaking in an investment firm group. 2. The following definitions are modified so that any reference to an undertaking that is incorporated in the UK or has its place of business in the UK includes an undertaking that is incorporated in the EEA or has its place of business in the EEA: a. GCT parent undertaking b. Investment firm group; c. UK parent investment holding company; d. UK parent mixed financial holding company; e. UK parent investment firm f. UK investment holding company; g. UK mixed financial holding company; and h. UK mixed-activity financial holding company. 3. The definition of “MIFIDPRU investment firm” includes the Firm and any other investment firm with its registered office or head office in the EEA, and which would be a MIFIDPRU investment firm if its registered office (or if it has no registered office, its head office) were in the UK. 4. All other rules and guidance in MIFIDPRU and SUP 16.12 must be interpreted so that any parent undertaking located in the EEA is treated as if it was located in the UK for the purposes of any obligation that pertains to groups, in a way that is consistent with the modifications in 2. and 3. 5. The Firm must ensure that any undertaking located in the EEA complies with any requirement in MIFIDPRU or SUP 16.12 that is expressed to be applicable to it as a result of the modifications in 1. to 4. 6. MIFIDPRU 7.2 (Internal governance), 7.2A (Risk management function) and 7.3 (Risk, remuneration and nomination committees) do not apply to the Firm. 7. The Firm is not required to submit FIN067 (Supplementary capital data for collective portfolio management investment firms).
